Terms & Conditions

Mayur Jewellers Terms & Conditions govern the use of the platform and its digital gold services, including user eligibility, account usage, KYC, transactions, storage, delivery, payments, refunds, and user responsibilities.


These Terms of Use (“Terms” / “Agreement”) govern your access to and use of the Mayur Jewellers mobile application and website (“Platform”) and the services offered thereon.

By registering, accessing, or using the Platform or any services offered by Mayur Jewellers Private Limited (“Mayur Jewellers” / “Company” / “We” / “Us” / “Our”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform and should uninstall/delete your account.

This document is an electronic record in terms of the Information Technology Act, 2000 and applicable rules, and does not require any physical or digital signatures.

1. Definitions

Unless the context otherwise requires:

“User” / “You” / “Your” means any person who accesses or uses the Platform, including a customer who buys, sells, stores, or requests delivery of gold or other products via the Platform.

“Digital Gold Services” means services relating to purchase, sale, storage, and delivery of gold or similar products made available through the Platform.

“Business Partners” means banks, bullion providers, payment gateways, logistics partners, and other third parties with whom Mayur Jewellers has contractual arrangements for providing the services.

“Customer Gold” means the quantity of gold purchased by you through the Platform and stored on your behalf with a custodian or vault provider.

“Account” means the user account created by you on the Platform, including any sub‑accounts related to specific services.

“Force Majeure Event” has the meaning given in Section 17 below.

Additional terms may be defined in specific sections of these Terms and will have the meanings assigned to them there.

2. Eligibility


By using the Platform, you represent and warrant that:

You are at least 18 years of age and are competent to contract under Indian law.

You are an Indian citizen and currently resident in India, unless Mayur Jewellers expressly permits otherwise.

You are using the Platform on your own behalf and not on behalf of any person without valid authorization.

The information and documents provided by you (including KYC and Officially Valid Documents) are true, correct, and relate to you.

You are not registered under the Goods and Services Tax Act, 2017; if your GST status changes, you will promptly notify Mayur Jewellers in writing and provide relevant details.

Mayur Jewellers reserves the right to terminate or suspend your access to the Platform if any eligibility criteria or representations are found to be untrue or inaccurate.

 

3. Registration and Account

To use the services, you must register and create an Account on the Platform and provide accurate, complete, and updated information as requested.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.

You agree to promptly update your KYC, contact details, and any other information whenever there is a change.

If Mayur Jewellers believes any information provided by you is untrue, inaccurate, outdated, or incomplete, Mayur Jewellers may suspend or terminate your Account without liability.

4. Nature of Services and Role of Mayur Jewellers

Mayur Jewellers provides a technology Platform that facilitates access to Digital Gold Services offered in partnership with one or more bullion providers and service partners (“Bullion Provider(s)”).

Through the Platform, Users may place orders to buy, sell, store, or request delivery of gold products as enabled from time to time.

The underlying bullion and related services (vaulting, insurance, delivery, etc.) are provided by the relevant Bullion Provider(s), not by Mayur Jewellers. Mayur Jewellers’s role is limited to acting as an intermediary/facilitator and providing Platform and payment facilitation services.

In addition to these Terms, Users may be bound by the terms and conditions of the Bullion Provider(s) and other Business Partners, which shall, to the extent of any conflict, prevail for the specific bullion services. Hyperlinks to such terms may be provided on the Platform.

Mayur Jewellers does not provide investment, tax, financial, or legal advice. You are solely responsible for your investment decisions.

5. KYC and Verification

Users may be required to provide PAN and other KYC documents as mandated by applicable law or by Business Partners.

Mayur Jewellers and/or its Business Partners may, at their discretion, request additional documents or information, and may reject or cancel transactions where KYC is incomplete or unsatisfactory.

You consent to Mayur Jewellers and its partners using, sharing, and verifying your KYC data for compliance, fraud prevention, and service provision, in accordance with applicable law and the Privacy Policy.


6. Authorization

You hereby authorize Mayur Jewellers to act as your limited agent for:

Facilitating purchase, sale, storage, redemption, transfer, or delivery of Customer Gold through Bullion Provider(s) and custodians.

Managing any unclaimed balances or dormant Customer Gold in accordance with applicable law and contractual arrangements with Business Partners.

Taking such actions as may be reasonably necessary to process your instructions and transaction requests on the Platform.

All actions taken by Mayur Jewellers under this authorization shall be binding on you.

7. License and Restrictions on Use

Mayur Jewellers grants you a limited, non‑exclusive, non‑transferable, revocable license to use the Platform for your personal, lawful, and non‑commercial use, subject to these Terms.

You agree that you will not:

Copy, modify, distribute, sell, resell, or otherwise exploit any content or portion of the Platform, except as expressly permitted.

Use the Platform in any way that may damage, disable, overburden, or impair it or interfere with other users’ access or rights.

Publish or redistribute real‑time gold prices or other proprietary information from the Platform in any medium.

Attempt to gain unauthorized access to any systems, data, or networks related to the Platform.

8. Placing Orders and Transactions

Prices displayed on the Platform are indicative buy/sell quotes and constitute an invitation to offer; your confirmed order is your offer to buy or sell gold.

Orders are typically on a pre‑payment basis. Upon successful payment and KYC verification (if applicable), the Bullion Provider will confirm your order and allocate the corresponding quantity of Customer Gold to you within a reasonable time.

Gold once purchased may be subject to a minimum holding period before sale (if such a restriction is configured by the Bullion Provider or Mayur Jewellers and notified on the Platform).

Mayur Jewellers and/or the Bullion Provider may, at their sole discretion, delay, reject, suspend, or cancel any transaction due to technical issues, market conditions, risk or fraud concerns, regulatory reasons, or any other valid reason. In such cases, amounts debited (if any) will be refunded in accordance with applicable partner terms.

Mayur Jewellers may prescribe minimum and maximum transaction limits (per transaction/day/month etc.), which will be displayed on the Platform and may be revised from time to time.

All gold purchased through the Platform remains the sole property of the respective User, subject to applicable laws and partner terms.

9. Storage, Insurance, and Delivery

9.1 Storage

Customer Gold is stored in secure vaults operated by the Bullion Provider or its appointed custodian, on your behalf.

Free storage may be provided for a specified period as notified on the Platform; thereafter, storage charges may apply at rates displayed and updated from time to time.

Mayur Jewellers is not responsible for physical safekeeping of Customer Gold; this is handled by the Bullion Provider and/or custodian under their terms.

9.2 Insurance

The Bullion Provider is expected to maintain appropriate insurance coverage for Customer Gold stored in vaults, as per industry practice.

Insurance may cover specified risks (e.g., fire, theft) but may exclude others (e.g., war, nuclear events), as per the policy/ies.

In insured events, claims will be handled by or through the Bullion Provider/custodian in accordance with their terms.

9.3 Delivery

You may request physical delivery of eligible quantities of Customer Gold to a valid Indian address by placing a delivery request and paying applicable making, shipping, and other charges.

Identity and address verification may be required upon delivery; you should inspect the package and refuse delivery if tampered or inconsistent with your order.

If delivery fails due to your unavailability or incorrect address after reasonable attempts, re‑delivery or re‑shipment charges may apply.

If you do not request delivery within a stipulated maximum storage period (if any is notified), your Customer Gold may be handled as unclaimed in accordance with applicable law and partner terms (including possible liquidation and deposit of proceeds to your bank account or other mechanism).

10. Pricing, Payments, and Taxes

Gold prices on the Platform are derived using reference rates or formulas linked to prevailing bullion market prices, as determined by the Bullion Provider and may change frequently.

Payment methods available may include UPI, net banking, cards, or other instruments via payment gateways/aggregators.

All applicable taxes, duties, levies, or cess (including GST) on purchase, sale, storage, or delivery of gold are your responsibility and will be charged as per law.

Mayur Jewellers and its partners are not responsible for your personal tax filings or liabilities on gains or income; you should seek independent tax advice.

11. Returns, Refunds, Cancellations and Auto‑Invest

Once a payment has been successfully processed and a transaction confirmed, it is generally final and cannot be cancelled by you, except where expressly permitted under applicable law or partner terms.

In case of transaction failure, rejection, or cancellation by Mayur Jewellers or a partner after debit of funds, the amount will be refunded to your source account or as per partner policy.

If the Platform offers recurring or “auto‑invest” features, you may pause or cancel such mandates through the Platform or your payment app, as described in the feature‑specific instructions.

12. Offers and Rewards

Mayur Jewellers may run promotional offers, discounts, coupons, or reward programs from time to time.

Each offer may be subject to additional terms (eligibility, validity, usage limits), which will be communicated separately.

Offers are typically not combinable with other promotions unless expressly stated.

Mayur Jewellers may modify or withdraw any offer at any time without prior notice, and its decision shall be final in case of disputes related to offers.

13. Intellectual Property

All rights, title, and interest in and to the Platform, including content, design, text, graphics, logos, audio, video, trademarks, and software, are owned by Mayur Jewellers or its licensors.

You are allowed to use such material only for your personal, non‑commercial use and must not copy, distribute, modify, or create derivative works without prior written consent of Mayur Jewellers.

14. Termination and Suspension

Mayur Jewellers may, at its sole discretion, suspend or terminate your Account or access to all or part of the Platform at any time, with or without notice, including where: You breach these Terms, applicable laws, or partner terms; Required by law, regulation, or authority; There is suspected fraud, security risk, or misuse. You may close your Account by following the in‑app process or contacting support through your registered email. Consequences for any remaining Customer Gold or balances will be handled per these Terms and applicable partner terms.

15. Limitation of Liability

To the maximum extent permitted by law: Mayur Jewellers (including its directors, officers, employees, and affiliates) shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunities arising out of or related to use or inability to use the Platform or services. Mayur Jewellers’s aggregate liability, if any, arising from any claim relating to a transaction shall not exceed the fees or commission received by Mayur Jewellers for that specific transaction giving rise to the claim.

Gold prices are market‑driven and volatile; no returns or performance are guaranteed by Mayur Jewellers.

16. Indemnity

You agree to indemnify and hold harmless Mayur Jewellers, its directors, officers, employees, and affiliates from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: Your breach of these Terms or any applicable law; Your violation of any rights of a third party; Your misuse of the platform or services.

17. Force Majeure

Mayur Jewellers and/or its Business Partners shall not be liable for any failure or delay in performance of obligations caused by a Force Majeure Event, including but not limited to acts of God, war, riots, strikes, fire, flood, pandemic, governmental actions, failures of networks or systems, or any events beyond their reasonable control. During such events, obligations shall be suspended to the extent affected and for the duration of the event. Reasonable efforts may be made to resume services or provide alternative arrangements where feasible.

18. Change in Law

If any change in law, regulation, or regulatory guidance materially affects the provision of Platform services or Digital Gold Services, Mayur Jewellers may suspend, modify, or discontinue any part of the services without liability to you. Where reasonably possible and lawful, Mayur Jewellers will endeavor to facilitate sale, redemption, or delivery of your existing Customer Gold through the Bullion Provider or another partner.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without Mayur Jewellers’s prior written consent. Mayur Jewellers may assign or transfer its rights and obligations to any affiliate or third party as part of a restructuring, merger, or business transfer, subject to applicable law.

 

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to any mandatory dispute‑resolution process, the courts at Mumbai shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms or your use of the Platform.

 

21. Disclaimers

The platform and services are provided on an “as is," “as available” basis without warranties of any kind, whether express or implied, except as expressly provided in writing. Mayur Jewellers does not warrant that the services will be uninterrupted, timely, secure, or error‑free, or that any defects will be corrected. Any content or material downloaded or obtained through the platform is at your own risk, and you are solely responsible for any damage to your devices or loss of data.
